Update on Alimony and Time Share Bill

Here is the latest. The Florida Senate approved an alimony overhaul that would establish formulas for alimony payments. It also includes a provision dealing with time sharing.

The proposal was approved by vote in the Senate and now goes to the house.

The bill contains a compromise on time sharing. The current bill did away with a proposed presumption that children spend equal time between each parents. Instead, judges would begin with the premise that a minor child should spend approximately equal amounts of time with each parent.

If passed, the time sharing provision will only apply to divorces or child custody cases filed after October 1, 2016.

Under the proposed bill, the duration of alimony payments would be based on the number of years of marriage, while the amount of the payments would rely on a couple’s gross income- the higher earner’s salary minus the earnings of the spouse seeking alimony.
