Summer is here. Do you have your vacation all arranged? Are you lined up to go on vacation with your child or children? Does your former spouse have their vacation arranged? Are they all lined up to go on vacation with your child or children?
If you have gone through an Orlando divorce, you should have a Parenting Plan. It should have a paragraph about out of state travel and a paragraph about out of country travel. It should state how many days or months in advance you must notify the other parent of your travel plans. It should also state what you must provide the other parent in advance of the travel. For example, one month prior to travel, the traveling parent should provide a detailed itinerary to the other parent. This should include airline information including the flights and time of the flights. It should also include the hotels in each city where you are staying and the contact information regarding the hotel. You should also provide all cell numbers where the other parent can reach you and the child or children.
As a practical matter, if you are traveling out of country with your child or children, you need to make sure that you have already gotten their passport several months in advance of the travel. Also make sure the passport does not expire for 6 months after the date the travel is to be completed.
If you do not have a passport for the child or children, then you need to obtain the paper work immediately. Both parents must sign the passport documents in order for you to obtain a passport for your child or children. You do not want the other parent denying his/her signature at the last minute and preventing you from enjoying your vacation with your child or children.
If the other parent denies the signature, you will need to go to court before the judge and get an order for them to sign the paperwork. However, it may take several months to get hearing time before the judge. Therefore, make sure the child or children’s passport is in order well before your travels.
