What Is a Nonadversarial Divorce?

An Orlando nonadversarial divorce is one that is uncontested with no litigation. A Nonadversarial divorce means that the parties do not fight each other contentiously in court. The parties work together to resolve their case without any fighting. The parties work in a collaborative manner.

This is the opposite to an adversarial divorce where the parties oppose, contest and attack each other. In an adversarial divorce, every step of the way can be a battle. The parties fight on all issues that need to be resolved in the case.

An Orlando nonadversarial divorce is one where the parties file their petition for dissolution and corresponding pleadings including an answer. Than the parties negotiate back and forth. They work out all the issues and enter into a settlement agreement. They do this after full mandatory disclosure. After learning all their assets and debts, they amicably divide their assets and debts. If alimony is appropriate in their case, they come to a peaceful resolution regarding alimony too.

If they have children, they come to a collaborative agreement on the parenting plan and child support. They have their attorneys work back and forth in a positive manner to settle all the above mentioned issues.

This saves the parties the money they would spend on interrogatories, requests to produce, requests for admissions, subpoenas, expert witnesses, depositions, evaluations, hearings, mediation, and trial.

This is much better psychologically for the parties. They avoid the stress and animosity that goes along with a very contentious divorce. They avoid slinging mud at each other.

If they have children, it spares the children from a long drawn out custody battle. It is a copacetic way to resolve the case.

Parties that reach their own conclusions are much happier with their results than if they go to court. They have chosen exactly what they want. They have not been told by a judge that this is how it is going to happen. The parties have decided their own outcome. They do not have to worry as to how the judge will rule.
