What changes do you need to make after your Orlando, Florida area divorce is finalized?
If you want to return to your maiden name, you need to make sure you change your name to your maiden name in the final judgment of dissolution of marriage. You must plead for name change in your petition for dissolution of marriage. If you do not do it then, you will regret it because after the divorce it is a lengthy process of detailing the information required in order to get your name changed. However, during the divorce you must state that you do not have criminal charges or bankruptcy in your married name. That is much easier. Then you return to your maiden name in the final judgment.
After the divorce, if you have taken your maiden name then you need to take a certified copy of the final judgment of dissolution of marriage to the the social security administration to have that information updated. You must also do the same with your Florida driver’s license at the Florida Department of Motor Vehicles. You need to do this for all accounts, etc.
You also need to change your will, if you have one. Most divorced persons would not want their ex-spouse to inherit from them if they were to die. Seek an attorney such as Ian L Gilden, Esquire of Ian L Gilden, PA to update your will. You may contact Ian L Gilden, P.A. at 407-732-7600.
If you are to remain on your spouse’s life insurance as the beneficiary for child support or alimony reasons, you need to contact the insurance company and have your spouse redesignste you as the beneficiary after the divorce is finalized. This applies to retirement accounts too, if they were not divided by QDRO ( Qualified Domestic Relations Order).
If you were designated as a beneficiary on your spouse’s policies, that designation ends at divorce pursuant to FS 732.302(2). The only way you may remain as the beneficiary on your ex-spouse’s policies is for the ex-spouse to redesignste you as the beneficiary after the divorce.
Make sure you have all quit claim deeds signed and filed after the divorce, if ordered in the final judgment.
Make sure you change the titles on motor vehicle etc. if ordered in the final judgment. This applies to bank accounts and credit cards too.
If you divided your retirement account by QDRO in final judgment, make sure you get that done.
If you have further questions on these matters, you may contact Ann Marie Gilden, Esquire of Ann Marie Giordano Gilden, P.A. at 407-732-7600.
