The Florida Alimony Statute is 61.08.
Either party in a dissolution may seek alimony.
There are different kinds of alimony in Orlando, Florida that a judge may award. They are:
- Bridge the Gap Alimony
- Rehabilitative Alimony
- Durational Alimony
- Permanent Alimony.
The court may award any of these or a combination of them.
The court may order periodic payments or lump sum or a combination of both.
The court must determine if one spouse has the need for alimony and the other spouse has the ability to pay alimony.
The court must determine the proper type of alimony in Orlando and the amount of alimony to be awarded.
The court must make factual findings regarding the parties nerd and ability to pay.
The court must also evaluate and make findings of fact the following factors:
1. The standard of living during the marriage.
2. The duration of the marriage.
3. The age and physical and emotional condition of each party.
4. The financial resources of each party including the nonmarital and marital assets and liabilities.
5. Earning capacities, education level, vocational skills and employability of each party; and the sufficient time of such party to obtain education to obtain appropriate employment.
6. The contribution of each party to the marriage in regards to homemaking, raising children, contribution to other spouse’s career and education.
7. Responsibilities each parent will have regarding the minor children in common to the parties.
8. The tax consequence of alimony to each party, including the designation of any or all part of payment as nontaxable and nondeductible payment.
9. All assets of the parties including income from investments held by that party.
10. Any other factor necessary to do equity and justice between the parties.
The court may order either party to obtain life insurance to cover alimony.
For the determination of alimony, the terms of the marriage are as follows:
Short Term-under 7 years
Mid Term Range- 7 years to under 17
Long Term-17 years and longer.
