Things to Know When Getting a Divorce in Orlando, Florida Area

You may not know these things. This is helpful information if you are getting a divorce in the Orlando, Florida Area:

The Florida Statutes relevant to a dissolution of marriage case are:

  • 61.075 Equitable Distribution. This statute discusses the valuation and division of the assets and debts. 
  • 61.08 Alimony. This statute explains the different types of alimony and when you are entitled receive the different types of alimony.
  • 61.16 Attorney’s Fees. This statute discusses Attorney’s fees and when you are entitled to them.
  • 61.13 Best Interest of the Child. This statute explains the analysis the judge will use to determine the time-sharing schedule.
  • 61.30 Child Support. This statute explains how the court calculates the child support in a case. In order for you to determine the child support, you must know your net income, other party’s net income, the cost of health insurance for the child, the cost of your health insurance, the cost of other party’s health insurance, and the cost of daycare.

If you read these statutes, you will have a better concept of the divorce process. 

The following counties have Administrative orders of how you must behave and what you are allowed to do during the dissolution of marriage process:

  • Orange County;
  • Seminole County; and 
  • Volusia County. 

You should read the Administrative Order in the county where your dissolution of marriage is being heard. That way you know what you can and cannot do. It also explains what is appropriate and acceptable behavior during the divorce; and how you should act during the divorce. 

The Administrative Order requires the following:

  • That you not change the child’s school zone. 
  • That you only spend money for ordinary living expenses. 
  • That you not dissipate the assets. 

If you have children under the age fourteen (14) years of age, then you are required to take a parenting course. They have online and in person parenting courses. You need to check with the clerk in the county where your divorce is being heard to see if the court will accept an online parenting course or you must attend the parenting course in person.
