What Can You Do If You Think a Friend, Relative or Loved One Is Incapacitated?

In Florida you can see a Guardianship and Elder Law Attorney regarding the legal aspects of your situation. The attorney can discuss the legal ramifications of incapacity with you and what that curtails. They can give you options on how you can proceed. They can also point you in the right direction of experts who can assist the alleged incapacitated person. 

Further, there are things you yourself can do to assist the alleged incapacitated person to wit:

  1. Makes sure they are getting balanced meals. 
  2. Help them with appointments. 
  3. Help them administer their medications. 
  4. Help them with transportation issues.
  5. Help them keep their regularly scheduled doctors’ appointments. 
  6. Make sure they are eating and drinking. If they are not, seek immediate expert attention. 
  7. Approach them without bias or preconceived ideas. 
  8. Acknowledge and address assets and deficits. 
  9. Approach them as individuals. 
  10. Approach them with respect and kindness. 
  11. Approach them with the same positive regard and caring that we would give children. 
  12. Check for sudden unexplained weight loss. 
  13. Check for multiple medication errors.  
  14. Watch for sudden lack of attention to hygiene. 
  15. Check for sudden onset of confusion. 
  16. Take steps to optimize capacity. 
  17. Take them to have them evaluated by a neurologist and or psychologist. 
  18. See what their primary care doctor has documented regarding their capacity. 
  19. Look to see if they have had difficulty writing checks and balancing their check book. 
  20. Look to see if there have been unusual withdraw from the checking account and large withdraws. 
  21. Have they gotten lost going to the grocery store?
  22. Make sure that they see all the professionals who work with them.
  23. Check if they are oriented to person, place, and time. 
  24. Check their attention and concentration. 
  25. How is their past memory?
  26. How is their recent memory?
  27. How are their problem-solving skills?
  28. How is his/ her abstract thinking?
