What are the dangers of social media postings during a marital and family law case in the Orlando, Florida area? Whether you are in the middle of a dissolution of marriage case, a modification of time-sharing, or a child support case, be careful of what you post on social media during your Marital & Family Law case in the Orlando, Florida area. The post could come back to haunt you. Think twice before you post. You just may be venting or blowing off steam. However, would you want the judge that you will appear before in court hearing all about that post? It could reflect negatively on your character and the image you present to the judge in court. Do not post profanity-laced tirades. Do not belittle the opposing party. Do not post anything you would not want the opposing party to see. You may have blocked the opposing party or unfriended them from your social media. However, there is a likely chance that a mutual friend or relative of the opposing party will see the post and inform them of it. The next thing you know, the opposing counsel will have sent your attorney a motion to preserve the post and prevent the spoliation of evidence. Such a post can come back to haunt you. The best practice or advice is not to post when you are angry. You may want the world to know how bad you think the opposing party is and why, but you will only regret the posting when it is in the hands of the opposing party’s counsel who is introducing the post into evidence during your hearing or trial. Once it is written, it is forever memorialized. The same thing goes for pictures, videos, and recordings you would not want the judge to see.
Do not leave nasty messages on voice mail recordings. Do not post pictures that could be embarrassing to you in court. Do not posts videos of you ranting on social media. These are all things not to do because they can be introduced into evidence against you at your hearing or trial.
