New Notary Law in Florida on Remote Signature by Notary Effective January 2020

Did you know that effective January 2020 Florida Law now allows a notary to notarize signatures that were signed remotely? However, you must use a notary that is qualified to do this. For the notary to be qualified to do this, they must take a course and meet the other necessary additional qualifications. Further, there are special requirements when a notary notarizes a document remotely. The details of remote notarization can be found in Florida Statute 117.05. To be a remote notary a notary must take a 2-hour course, post a $25,000.00 bond, and obtain a $25,000.00 errors and omissions policy. 

The information required under the new law effective January 2020 for the notary block is as follows: 

FOR AN INDIVIDUAL:

The new notary block must have the following language effective January 1, 2020:

STATE OF _______________

COUNTY OF+_____________

The forgoing instrument  was acknowledged before me by means of 

________ physical presence or __________ online notarization, this DATE ___________ by PERSON ACKNOWLEDGING, ________________who is personally known to me or who has produced TYPE OF IDENTIFICATION ________________________ as identification.

Signature of person taking acknowledgement __________________________________

Name typed, printed or stamped ____________________________________________

Title or rank ____________________________________________________________

Serial number if any ______________________________________________________

That notary block must be used after January 1, 2020 regardless of whether the notary is notarizing the signature in person or remotely online. 

The legislature is working on a glitch bill for all documents notarized from January 1, 2020 to  currently that did not use the new statutory language because this language was mandatory and required effective January 1, 2020. Therefore to meet the certain new requirements that were necessary in the  notary block, but may have been overlooked when the law first came into effect, the glitch bill will remedy any documents that were signed with the old notary block and not the new notary block since January 1, 2020.
