Do you need a vocational expert for your Orlando, Florida area divorce? Why would you need such a vocation expert for your divorce? You would use such an expert regarding the issue of alimony. A vocational expert evaluates the spouse seeking alimony to determined based on their education, prior work experience, and jobs available in the community whether they should be gainfully employed and their potential earning ability. The expert can determine if the spouse requesting alimony is voluntarily underemployed. This applies to alimony and child support for both the requesting spouse and the payer spouse.
A vocational expert can evaluate the spouse that would have to pay alimony or child support to determine if that spouse is voluntarily underemployed. Did that spouse quit their job to avoid paying alimony or child support? Did they accept a lower-paying job to minimize support? Do they work fewer hours? Do they assert that those economic conditions have dramatically altered their earning potential?
The vocational expert will assess the person including education, work experience, skills, knowledge, interests, licenses they possess, titles they possess, certificates they possess, etcetera. The vocational expert will engage in labor market analysis to further assess a person’s ability to obtain employment. They will assist in objectively documenting the employability and earning capacity in a case.
A vocational expert can provide a client with a comprehensive vocational and life care plan evaluation. They can also do aptitude testing. They can deliver vocational and earning capacity reports for their clients. You need to weigh all the advantages of retaining a vocational expert and determine if you can financially afford to hire a vocational expert in your case. You could also ask the court to have the other spouse pay for your expert if you have a need for costs and suit money and the other party has the ability to pay your costs and suit money. You would have to file a motion for the court to request that.
