New Law to Help Protect the Elderly and Disabled Adults from Abuse in the Orlando, Florida Area

On July 1, 2021, Florida House Bill 1041 became law. This new law gives more protection to elderly and disabled adults in the state of Florida.  

For one, this new law adds offenses to the authority of the Office of the Statewide Prosecution. Under this new law, a person convicted of abuse, neglect, or exploitation of an elderly person or disabled person is not qualified to act as a personal representative of an estate. 

The new law provides for forfeiture of specified benefits of persons convicted of offenses concerning the elderly or disabled persons. With this new law, a person convicted of offenses concerning elderly or disabled adults may still retain inheritance, survivorship rights, other rights, or trust interests if the victim executes specified instruments. 

This law specifies additional conduct that constitutes abuse or exploitation of an elderly person or a disabled adult. This includes revised provisions concerning injunctions for protection. It also provides for extension of ex-parte temporary injunctions.
