Greyson’s Law in an Orlando, Florida Custody or Divorce case

Why will Grayson’s Law be important if you have an abusive spouse that you fear will harm you or your child during the pendency of an Orlando, Florida divorce or custody case. Senate Bill 130 known as Grayson’s law is important because it sets out new factors the court must analyze in making its custody and visitation decision. Grayson’s law adds protection for children in danger of parental harm.  Grayson’s Law expands Florida Statute 61.13 factors the court must consider when determining whether shared parental responsibility would be detrimental to the child. Senate Bill 130 known as Grayson’s Law will take effect on July 1, 2023. 

The Court will now be required to consider threats against ex-partners or spouses when making child visitation and custody determinations in court. The expanded factors are as follows: evidence of domestic violence, whether a parent in the past or currently has reasonable cause to believe that he or she or minor child is or has been in imminent danger of becoming the victim of domestic violence or sexual violence by the other parent, even if no other legal action has been brought or is currently pending in court; whether either parent, in the past or currently, has reasonable cause to believe that the shared minor child is or has been in imminent danger of becoming a victim of abuse, abandonment; and any other relevant factors. 

Further, when a court makes a determination regarding parental responsibility or time sharing, the best interest of the child factors  are now expanded to include evidence that a parent has or has had reasonable cause to believe that he or she or the minor child is in imminent danger of becoming the victim of domestic violence.
