How Has Greyson’s Law Impacted the Best Interest of the Child Factors in the Orlando, Florida Area?

Florida Statute 61.13 lists the factors of Best Interest of the Child. You can look up Florida Statute 61.13(3) and read the factors of Best Interest of the Child listed in (a) through (t). Effective July 1, 2023, there was a new law enacted in Florida called Greyson’s Law. You can look up Grayson’s Law and read all about it.  

According to the article, “Developments in Domestic Violence,” by Leo Vera, Esquire and Kristina Lawrence, Esquire, in Florida Family Law Commentator Issue No.1, 2023, “Before Greyson’s Law, courts considered evidence of domestic violence, sexual violence, child abuse, child abandonment, or child neglect under 61.13(3)(m).” The authors of the article state that this subsection has now been expanded to require consideration of evidence that a parent has or has had reasonable cause to believe that he/she or his/her minor child or children are in imminent danger of becoming a victim of an act of violence. All considerations to be considered under this subsection are to be considered regardless of whether a prior or pending action relating to those issues has been brought. 

Greyson’s Law became effective July 1, 2024. Greyson’s Law provides new tools to victims of abuse and coercive control in their Timesharing and Parenting Plan issues of their cases. It gives the victim a broader spectrum to demonstrate what they have suffered to the court and how it has affected them and their child or children.

Further, there are domestic violence experts that you can hire to analyze your case and testify as an expert on domestic violence and domestic violence by coercive control. An expert like this can aid your case to explain to the court and better help the judge in court to understand what domestic violence is and to understand the concept of domestic violence by coercive control.
