What exactly is Marital and Family Law? It is also referred to as Family Law. What does Marital and Family Law encompass? The term Marital and Family Law or Family Law encompasses the areas of practice of law that is compromised of and includes divorces, collaborative divorces, prenuptial agreements, marital settlement agreements, post nuptial agreements, custody, paternity, child support, alimony, relocation, long term custody by an extended family Members, name change, disestablishment of paternity, DCFS adoptions, stepparent adoptions, and adult adoptions. It also includes modification and contempt or enforcement issues of the above-mentioned areas.
In a Marital and Family Law cases, you are not required to hire an attorney for such a case. You may proceed on your own and represent your self. When you do that, you are considered Pro Se in the litigation. Pro Se is a Latin term that means on one’s own behalf. It is used to describe someone who represents themselves. However, if your opposing party hires an attorney, it is probably wise to hire your own attorney. In Marital and Family Law cases, you are allowed to ask for attorneys fees. Attorney’s fees are awarded if one party has a need for attorney’s fees; and the other party has the ability to pay the other party’s fees. If you are in deficit each month after paying your ordinary living expenses, then you have a need for attorney’s fees. If the opposing party has a surplus each month, then they have the ability to pay your attorney’s fees.
