Difficulties in Divorcing a Spouse With Mental Health Issues in the Orlando or Lake Mary, Florida Area 

A divorce from a spouse with mental illness is usually more difficult and more litigious than a run-of-the-mill divorce. This is because the spouse with mental illness may not be on proper medication, may not be taking their medication, may not seeing their therapist/psychiatrist/psychologist, or even with all of the above they still may be a difficult individual to deal with during the divorce proceedings. 

Many times, spouses with mental illness have lost their jobs or moved around from job to job because they have problems with coworkers at work. However, many times they blame all their problems on the spouse who does not have mental illness. They project their actions and behaviors on the opposing spouse and accuse them of bad behavior. 

This can be very stressful emotionally and psychologically for the spouse who does not have mental health issues. Many times they are at wits-end. They have been to marriage counseling; they have tried over and over again to deal with their spouse who has mental illness. Now, they can no longer tolerate the spouse’s behavior. The spouse with mental illness then blames the spouse without mental illness for ruining the marriage and their future plans. 

On top of that, many times spouses with mental illness have caused financial ruin for the family. They may have over spent during the marriage. They may not have paid bills. They may have engaged in nefarious activities. All of this must be dealt with during the case. 

Further, they are more likely to have unrealistic goals and hinder meaningful settlement negotiations. This all must be dealt with during the case. All these additional problems the attorneys must deal with means most likely the attorney fees will be higher than in the usual divorce case.
