How can you have big savings with an uncontested divorce? You can save money with an uncontested divorce because you will not be paying an attorney for expensive, contentious and sometimes protracted litigation. You save all that money on attorney’s fees. The money goes in your pocket and not the attorney’s pocket.
You can do the paperwork yourself, or you can have an attorney do it. However, you spend relatively little on an attorney for an uncontested divorce in comparison to a contested dissolution of marriage. Further, the divorce is usually completed in a few months versus eighteen months or more for litigation.
With an uncontested dissolution of marriage, you save on time and the stress of litigation. One party can have an attorney represent them and draw up the paperwork. The other party can have an attorney throughout the process, too. Or they may just want an attorney to review the Marital Settlement Agreement before they sign it. Some people wish to proceed Pro Se and not hire an attorney, but instead represent themselves.
You can get all the paperwork done and then file it all at one time. Then, after twenty (20) days, the attorney who prepared the paperwork can file a final judgment with the court after the approval of the other side.
For an uncontested dissolution of marriage, it is best that you each file a financial affidavit. You can waive mandatory disclosure pursuant to Florida Family Law Rule 12.285. You can even waive the financial affidavits. Yet, each party needs to complete a financial affidavit at a minimum. Each party will fill out a notice of social security number form, an affidavit of non-military service, and a financial affidavit. One party files a Petition for Dissolution of Marriage. The other party files a Waiver and Answer. You file your Marital Settlement Agreement, too.
Your attorney will make sure all the paperwork on the judge’s uncontested dissolution of marriage checklist is completed. Then they submit the final judgment to the court with a cover letter. This is an easy, quick process to obtain a divorce.
