The safest way to protect yourself to receive Orlando child support is request an IWO. That is an Income Withholding Order. With an income withholding order, the amount that the payor owes the payee per month in child support is deducted from the payor’s employment check and it is sent to the State Disbursement Unit in Tallahassee which then disburses the funds to the payee. The disbursement unit in Tallahassee can set it up so that you receive the payment by direct deposit from Tallahassee to your account, or they can put the amount on a prepaid credit card for you. This is very efficient unless the payor loses his/her job or obtains another job. That is why there should be a clause in your settlement agreement and/or judgment that requires the payor to notify the payee within 5 days of change of employers. This method of using an IWO may not work well if the other spouse is self-employed and writes his/her own paycheck. You would have to believe that he/she is reliable and would actually write a check to you.
You can accomplish the above by the payor making payments through the disbursement unit in Tallahassee. In both cases, the clerk of court keeps a record of the payment. If the payor spouse fails to pay, you may obtain a certified copy of child support arrearage through the clerk of court for a fee.
If you have an ex-spouse or father/mother of a child who is not paying child support but was court ordered to do that, you may file a Motion for Contempt of Court for not paying child support. At the hearing your ex-spouse or mother/father may be put in jail until he/she pays you a purge amount if he/she is found by the judge or hearing officer to be in willful contempt of court. The purge amount is the amount of money that ex-spouse or Mother/Father has on hand. For example, if he/she owes $5000 in back child support which is referred to as child support arrears, but only has $5 in monies, bank accounts, or retirement accounts then the purge amount is $5. If he/she has $500 then the purge amount is that. If they have $5,000 then the purge amount is that. You should not the let arrears accumulate.
You may also request suspension of ex-spouse or Mother/Father’s driver’s license. The license may be suspended if the ex-spouse or Mother/ Father has an arrearage in child support.
Professional license suspensions. If you were married to a Florida attorney or he/she is the Mother/Father of a child that you receive child support for then he/she is required to keep their child support current, or risk having their license suspended.
