How May I Prepare Myself for My Upcoming Divorce or Custody Case?

If you are getting a divorce, or if you are involved in a custody case, it is a very good idea to keep a journal of what happens between you and your spouse. That way you have a record of the event as it happens. At that time, the event is fresh in your mind. In your journal, you should notate the date, the day of the week, and the time and place that the event took place. You should list any witnesses to the event and their contact information. If you do not record the event, then later at a later time when you try to recall it, you may not remember the event with great specificity as to what happened. It can be a great aid down the road to yourself and your attorney in preparing your case. If you ever have to give a deposition or go to trial, you can review your journal and make sure that all the important information is relayed.
Also, you should have all communications between you and your spouse in writing. This can be by email or text. That way, you have a record of what was said between the two of you. That record can be introduced at a hearing or trial to support your argument. If you talk on the phone, it can later become a he said versus she said as to what was actually said in a conversation. Then it becomes a credibility issue before the judge. Definitely do not record your spouse. It is a crime in Florida to record someone without their permission. Make sure you are always polite and courteous in emails and texts because if you are rude in an email or text, that will not benefit you during your court case.
