Dealing with Adult Protective Services During an Orlando, Florida Area Guardianship or Injunction for Protection Against Exploitation of a Vulnerable Adult Case

Many times, when you have a client filing an Injunction for Protection Against Exploitation or  Elder Abuse, you will deal with Adult Protective Services. Your client or someone else may have already called Adult Protective Services, or you will advise your client to call the abuse hotline in order to report the abuse and/or exploitation of the elderly person. When someone calls the 1-800-NO-ABUSE Hotline, and the alleged victim is an elderly person, then Adult Protective Services which is referred to as APS is the agency that will be sent to investigate the complaint. 

If there has already been a report that has been investigated, you may want to speak to and subpoena the APS worker for the Injunction and or Emergency Temporary Guardianship Hearing so they may tell the court the findings of their investigation regarding the exploitation and abuse. Since they are a neutral witness, they may be a valuable witness when you have a case of one person accusing another person or  family member of exploitation and/or abuse. The APS investigator may have already sent their investigative report to the State Attorney’s office to determine if criminal charges can be filed. This information can be invaluable. That information should be included in your Petition for Emergency Temporary Guardianship and Petition for Injunction for Protection Against Exploitation of a Vulnerable Adult.  

Any records and documents pertaining to the APS investigation can be a great resource also. They can be used as evidence at the Emergency Temporary Guardianship Hearing and Injunction for Exploitation Against Vulnerable Adult Hearing. That evidence should also be included in your Petition for Protection Against Exploitation of a Vulnerable Adult and Petition for Emergency Temporary Guardian.
