Yes, an adult can be adopted in the Orlando, Florida area. There is a process called an Adult Adoption. The Florida Statutes sections on Adult Adoption in Florida are Florida Statute 63.102 and Florida Statute 63.042.
What do you need to know if you want to adopt an adult, or if you are an adult who is going to be adopted?
First, know that someone who is adopted will no longer be in the line of intestate succession to inherit from their prior parent. The adoptee will now have all the rights that come with being the child of the new parent, and they will be in the line of intestate succession to inherit from them.
Why would someone want to file a petition for an adult adoption?
You may be a stepparent who wants to adopt your stepchild who is now an adult. It is easier to adopt now that they are an adult. When a child is a minor, you need the consent of the parents to adopt. However, you no longer need the consent of the parents to adopt an adult.
What steps do you need to take to adopt an adult?
You need to file a petition to adopt an adult in the Circuit Court. You will also need the consent of the person you are adopting. You will file their consent with the court. Further, you will need the consent of the adoptee’s spouse if they are married. You will also be required to file that consent.
After filing the Petition to Adopt an Adult and the appropriate consents, you may request a final hearing on the Adult Adoption. You must notify the biological parents of the adult being adopted before the Final Hearing on Adult Adoption. However, the parents cannot prevent the adoption.
You should obtain at least three certified copies of the final judgment of adoption for your records. Also, you must obtain a new birth certificate for the adoptee from the state where you were born.
