New Forms for Injunction for Protection Against Domestic Violence in the Orlando, Florida Area

If you are thinking about or preparing to file an Injunction for Protection Against Domestic Violence, then you will want to know that the Florida Family Law Forms were just amended regarding injunctions.
The Florida Supreme Court adopted five revised forms relating to petitions and temporary and final injunctions for protection against domestic violence so that the forms would be in accord with the provisions of chapter 741, as amended by the Legislature in 2020. The revision of a sixth form, 12.980(b)(2), while not prompted by legislation, was deemed necessary to clarify the form, and this amended form was also adopted by the Court. The amendment became effective immediately upon release of the Court’s opinion.
Interested persons were provided a 75-day period within which to file comments with the Court. IN RE: AMENDMENTS TO FLORIDA SUPREME COURT APPROVED FAMILY LAW FORMS-12.908(a)-(d). Opinion Filed June 17, 2021. Full Opinion at Supreme Court Opinions Section, page 182a.
The Supreme Court of Florida approved the Amendments to the following Florida Family Law Rules of Procedure & Family Law Forms:
- 12.980(a) (Petition for Injunction for Protection Against Domestic Violence);
- 12.980 (b)(2) (Order Denying Petition for Injunction for Protection Against Domestic Violence, Repeat Violence, Dating Violence, Sexual Violence, or Stalking);
- 12.980(c)(1)(Temporary Injunction for Protection Against Domestic Violence with Minor Child(ren);
- 12.980(d)(1)(Final Judgment of Injunction for Protection Against Domestic Violence with Child(ren)(After Notice); and
- 12.980(d)(2)(Final Judgment Injunction for Protection Against Domestic Violence without Minor Children)(After Notice).
The Court did this because in 2020, the Legislature amended chapter 741, Florida Statutes, the law governing petitions for temporary and final injunctions against domestic violence. See chapter 2020-37, Laws of Florida. Revisions of five forms relating to the petition and injunction so the form will be in accord with the provisions of chapter 74, as amended. Revision of a sixth form, 12.980(b)(2), was not promoted by legislation, but necessary to clarify the form.
