If You Are Contemplating a Divorce in the Orlando or Lake Mary Area, These Are Questions You Should Ask

You are contemplating divorce in the Orlando or Lake Mary, Florida area. Here are some of the initial questions that you should ask:

  • Should I go to marriage counseling? 
  • Have I already been to marriage counseling? 
  • Can marriage counseling save the marriage? 
  • Whether or not counseling was successful? 
  • If you already attended marriage counseling, is there nothing else that you can do to save the marriage? 
  • Are you emotionally ready to proceed with the filing of the dissolution of marriage? 
  • Or do you need individual counseling before you feel comfortable filing for divorce? 

Marital Residence Questions

If you are ready to file for divorce, where will the parties live? Will you both stay in the house pending the divorce? Will you move out? Will your spouse move out? 

Questions Related to Children

If you have children, how will you timeshare with the children if one of you leaves the house? How will you arrange transportation to exchange the children? Will it be Timesharing wherein you have one week with the children and the next week the children timeshare with your spouse? Will you use a 4/3/3 rotation for Timesharing? Will you use a 2/5/2 rotation for time sharing?  Which of these schedules will work best for your children, you, and your spouse? 

Who will pay for children’s health insurance if your work provides health insurance? Are there day care expenses for the children? Who will you allow to be a caregiver for the children? 

Alimony and Finance Questions

How long have you been married? Have you been married for a number of years; and you anticipate your spouse will request alimony? How much do you anticipate you will have to pay in alimony? How will that affect your finances?

Have you spoken to a financial planner regarding the effects of  divorce on your finances? Have you spoken with a CPA regarding the tax consequences of a divorce? 

Do you own a business? Will you need a business evaluation? Will you sell your house? Has there been an appraisal on the house? Can you afford to refinance and buy your spouse out of the house? Has your spouse dissipated assets? Will you need a forensic accountant?

Do you have any non marital assets? Have you kept these assets segregated during the marriage? These are things to ponder if you are contemplating a divorce.
