Divorce cases are stressful, and it can be easy to overlook required steps in a Florida dissolution of marriage case. Use this guide to understand some of the paperwork, courses, and financial information you may need to address.
Complete a parenting course if you have children.
If your case involves children, both parents must complete a parenting course. Before a judge signs the Final Judgment of Dissolution of Marriage, each parent must file proof of completion with the court, including the parenting course certificate.
File the required personal paperwork.
At a minimum, the paperwork identified for a dissolution of marriage includes:
- Petition for dissolution of marriage
- Financial affidavit
- Notice of Social Security Number form
- Affidavit of military service
- Copy of your Florida driver’s license showing an issuance date at least six months before you filed the petition, to document Florida residency
If you have children, also file the UCCJEA paperwork, a parenting plan, and your parenting course certificate.
Exchange mandatory financial disclosure.
Mandatory disclosure under Florida Family Law Rule 12.285 helps both sides understand the marriage’s finances. Documents to gather and exchange include:
- Pay stubs from the last six months
- Tax returns from the last three years
- A credit report
- Savings and checking account statements
- Credit card statements and other financial records
Why the Financial Records Matter
A full financial picture helps you negotiate an informed and equitable resolution. Whether you reach a Marital Settlement Agreement, settle through mediation, or go to trial, understanding the finances puts you in a better position to make knowledgeable decisions.
